§ 1 Information about the collection of personal data

The following provides information about the collection of personal information when you use our website. Personal data are all data that can be attributed to you personally, e.g. name, address, e-mail address, user behaviour.

The data controller according to Art. 4 No. 7 General Data Protection Regulation (GDPR) is Maxpert GmbH, represented by the Managing Director Hartmut Stilp, Lurgiallee 14, 60439 Frankfurt am Main (see our legal notice).

§ 2 Collection of personal data when you visit our website

If you use the website for information purposes only, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. When you visit our website, we collect the following information, which is technically necessary to display our website to you and to maintain and improve its stability and security:

  • Date and time of request
  • Time zone difference from Greenwich Mean Time (GMT)
  • Content of the request (specific page)
  • Access status/HTTP status code
  • Amount of data transferred
  • Website from which the request originated
  • Browser used
  • Operating system and interface
  • Language and version of browser software.
  • The legal basis is Art. 6 par. 1 sentence 1 lit. f) GDPR.
We use cookies on our website, i.e. in addition to the above data, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive and are assigned to the browser you are using, and through which certain information flows to the entity that sets the cookie (in this case, us). Cookies cannot run programmes or deliver viruses to your computer. They are used to make the website more user-friendly and effective overall.

1. This website uses the following types of cookies, the scope and functionality of which are explained below:

2. Transient cookies are automatically deleted when you close the browser. This includes, in particular, session cookies. Data Collection when Contacting us via form:

When you contact us by email or through one of the contact forms offered on this website, the data you provide (first name, last name, company, address, your email address - mandatory field, possibly your phone number, inquiry data) is stored by us to answer your questions about existing contracts or to provide a quote. The legal basis is Article 6(1)(b) GDPR.

If you send us a general inquiry, we process your data based on Article 6(1)(f) GDPR. Our legitimate interest is to respond to your inquiry.

Please ideally send documents with personal data in a sealed letter. If you want to send us documents with personal data via email, please note that these data could be viewed by third parties during transmission.

Data collection when booking a training via form:

When booking a training via form, we store the following data: company, order number, street and house number, postal code, city, indication of whether billing address and company address differ, email address for invoice dispatch; participant data: title, academic title, first name, last name, function, department, phone, email address, possibly another email address different from the participant's for order confirmation, and additional information you provide. We also store the training title (with/without examination). This data is stored on the legal basis of Article 6(1)(b) GDPR.

Conducting Online LIVE - Trainings:

For registration for Article26 trainings, participant data (name, first name, email address), training times, password, are processed. The data is provided by the training manager in your company or, if you register on our website, by yourself. The legal basis is Article 6(1)(b) GDPR.

For the conduct of online LIVE – trainings via video conferencing system, the following session information (participant name, device, IP address, location, network type, microphone, speaker, camera, data center, connection type, joining time, and end time) is processed. The legal basis is Article 6(1)(f) GDPR.

Subscription to the Newsletter via Form:

We store your email address when you subscribe to our newsletter using the opt-in procedure with revocation instruction and agree to receive our newsletter. If you voluntarily provide us with additional data, we will also store salutation, first name, last name, and company accordingly. In the newsletter, we inform you about our company and news, training, and services, as well as current offers. The legal basis is Article 6(1)(a) GDPR. With the newsletter registration, we store your IP address and the date of registration and confirmation. The storage serves the purpose of proof in case of misuse of your email address for newsletter registration. We store your email address and voluntarily provided data until you unsubscribe from the newsletter or revoke your consent. When registering, we use the so-called opt-in procedure. After registration, you will receive an email with a link to confirm your newsletter registration. If you do not confirm the link, the data will be deleted.

We process your data as an existing customer to send you advertising for similar products or services as those you have already used by post. In doing so, we process your data based on our legitimate interest in promoting our products and services. The legal basis is Article 6(1)(f) GDPR.

If you have provided us with your email address in connection with the purchase of a product or service or at the beginning of an existing customer relationship (existing customers), we use this email address for email advertising for our own similar products and services (§ 7(3) UWG, Article 6(1)(f) GDPR). We use the email address for advertising only if you have not objected to such use. You can object to the use at any time, without incurring any costs other than the transmission costs according to the basic tariffs. The contact details can be found in the imprint.

Applicant Data (Career Portal):

We process data that you transmit to us in connection with your application to assess your suitability for the position (or possibly other open positions in our company) and to conduct the application process. The following categories of personal data are included: contact details (first and last name, address), communication data (phone number, mobile number, fax number, email address, communication language), personal data (date of birth, place of birth, nationality, marital status, gender), job-related and personal data (desired place of work and working hours availability, salary request, willingness to move and travel, work permit), qualification data (school leaving certificate, education/studies, language skills, and professional skills), data on assessment and evaluation in the application process, data on the previous career, curriculum vitae, education and employment certificates, qualification certificates), application photo, and application history (consent to data storage).

The legal basis is primarily § 26 BDSG as well as other subsequently named provisions of the GDPR. According to § 26 BDSG, the processing of data is permissible that is necessary in connection with the decision on the establishment of an employment relationship.

Personal data is processed in the applicant management for the initiation of employment relationships, especially for the following purposes: comparison of job requirements and skills as well as the ideas of the applicant, defense against claims, communication with the applicant.

We store your data for the purposes mentioned above. We delete your personal data 6 months after the conclusion of the application process. In the event that you have agreed to further storage of your personal data, we will delete the data after the agreed period.

We are subject to various legal obligations, e.g., tax laws and the Commercial Code, which make the processing of your data necessary for legal compliance. These are data processing based on legal requirements according to Article 6(1)(c) GDPR.

Furthermore, you can give us your consent to send you information and additional offers by email for advertising purposes. You can revoke this consent at any time. The legal basis for this processing of personal data is Article 6(1)(a) GDPR. If we obtain your consent, you will receive a separate consent form that you can fill out voluntarily. The consent covers exactly the scope you desire.

If we process data to assert legal claims and defend against legal disputes, the processing is based on Article 6(1)(f) GDPR.

Partially, we use external service providers for the processing of your data as part of order processing. These have been carefully selected and commissioned by us, are bound by our instructions, and are regularly monitored with regard to the technical and organizational measures to be maintained. Processors may only process your personal data in the manner explicitly instructed by us. The processor must maintain technical and organizational measures to securely process your data.

Furthermore, we may disclose your personal data to third parties when contracts or similar services are offered jointly by us and partners. You will receive more information about this when you provide your personal data or as part of the description of the offer.

If our service providers or partners are located in a country outside the European Economic Area (EEA), we will inform you of the consequences of this fact in this privacy statement or the description of the offer. If we transfer personal data to third parties or to processors who are not in the European Economic Area, we will ensure in advance that the recipient has an appropriate level of data protection on their part. EU standard contractual clauses of the European Commission are agreed upon for this purpose, or the recipient is located in a country where, due to an adequacy decision of the Commission, an appropriate level of data protection exists (Article 45 et seq. GDPR). Otherwise, we obtain an expressly informed consent. In the case of the video conferencing systems used, the provider may be based in the USA. Upon request at the contact details mentioned above, we will inform you about the recipients in the event of your use of our services, as well as about the specific agreements with the service providers. 

§ 3 Duration of Storage

Your data will be processed for the first time from the moment of collection, to the extent that they are captured by the system or provided by you. We delete your personal data as soon as the purpose of processing ceases, all mutual claims are fulfilled, and there are no other legal retention obligations or legal justifications for storage. Records with personal data are stored for various purposes, as mentioned above. Different retention periods may apply depending on the purpose. If a purpose ceases to exist, the data must not be processed for it. If these data must be available for another purpose, the data related to the ceased purpose will no longer be used and will be blocked. They are then only available for the permissible purpose.

Personal data subject to the provisions of the Commercial Code (§ 257 HGB), such as business letters, will be destroyed or deleted after 6 years. Personal data subject to the provisions of the Fiscal Code (§ 147 AO), such as invoices and accounting documents, will be destroyed or deleted after 10 years.

Data of prospective customers or data related to inquiries that do not concern an existing contractual relationship will be deleted three months after the inquiry, if no contract is concluded, or after the completion of your inquiry.

YouTube

YouTube is a trademark of Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"). We embed YouTube videos on our site: https://www.youtube.com/@Article26-uc9ve

The YouTube videos will only play if you explicitly click "Accept." As long as you do not access the video by clicking "Accept," no cookies will be set, and no data will be transmitted to YouTube and the Google network.

When the video is accessed, a connection to YouTube servers is established, triggering additional data protection processes. We have no influence on this but assume that Google collects information about user behavior. According to the provider's information, video statistics are created to improve user-friendliness and prevent abuse. Once you are logged in to Google, the processed data when using YouTube is linked to your account. If you do not want this, please log out before using our YouTube offering.

In general, Google stores data when using this offering, even if you are not logged in. The created usage profiles are also evaluated. The legal basis for this is Art. 6 para. 1 sentence 1 lit. f) GDPR, legitimate interests of Google in displaying personalized advertising, market research, and the needs-based design of its websites. You have the option to object to the creation of usage profiles with Google.

We use Google Analytics on this website, which is a web analytics service provided by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google").
